These terms set out how we work together to create something brilliant. Please have a read through them – we've kept things straightforward and fair.
1. Agreement to Terms
By working with Made with Magic ("we," "us," or "our"), you're agreeing to these Terms of Service ("Terms"). If you're not comfortable with any part of these terms, please get in touch so we can have a chat about it.
These Terms apply to everyone who uses our web design, development, and related services here in beautiful Taranaki and beyond.
2. What We Do
Made with Magic specialises in creating digital experiences that truly connect with people. Our services include:
- Custom website design and development
- E-commerce stores that actually convert
- Search engine optimisation (SEO)
- AI integration and automation
- Website maintenance and ongoing support
- Digital marketing services
- Content creation and copywriting
Each project is unique, so we'll work out the specific details, pricing, and what you'll receive in your individual project agreement.
3. How We Work Together
3.1 Our Process
Our approach is simple, but it helps make sure every project runs smoothly:
- Consultation: We sit down and discuss your vision and needs
- Design: We create mockups and get your approval
- Development: We build your website with magic (and regular updates)
- Review: You test everything and let us know what needs tweaking
- Launch: We make your site live and ready for the world
- Support: We're here to help whenever you need us
3.2 Timeframes
Most projects are completed within 2-4 weeks, with regular updates throughout. We'll agree on specific timeframes in writing for each project. Sometimes things take a bit longer due to:
- Delays in receiving feedback or materials from you
- Significant changes to what we originally planned
- Technical challenges we didn't expect
- Third-party services playing up (as they sometimes do)
4. Payment Terms
4.1 Pricing
All prices are in New Zealand Dollars and exclude GST unless we specify otherwise. Final pricing might vary based on how complex your project becomes – we'll always discuss this with you first.
4.2 Payment Options
- Standard Payment: Full payment when your project is complete
- Payment Plan: 10% down payment, then 10% monthly until it's all sorted
- Ongoing Services: Monthly billing for hosting, support, and maintenance
4.3 Late Payments
We'd appreciate payment within 30 days of your invoice. If payments are running late, we might need to pause services and could add some fees – but we'll always chat with you first.
5. What We Need From You
To create something brilliant together, we'll need you to:
- Give us clear project requirements and let us know what you're after
- Provide content, images, and materials when we need them
- Give us feedback promptly during review phases
- Make sure all content you provide is yours to use or properly licensed
- Keep up with payments as agreed
- Test everything thoroughly before we launch
6. Who Owns What
6.1 Your Ownership
Once you've paid in full, you own your website and all the custom code we've built specifically for your project. It's yours to keep.
6.2 Third-Party Bits
Sometimes we use third-party components, plugins, or assets that come with their own licensing terms. We'll always let you know what these are.
6.3 Showcasing Our Work
We'd love to show off the brilliant work we've created together in our portfolio and marketing materials. If you'd prefer we didn't, just let us know in writing.
7. Hosting and Looking After Your Site
7.1 Hosting Services
We provide hosting through trusted providers like Wix, Shopify, and WordPress hosting. Hosting costs are separate from development and might change if our providers adjust their pricing.
7.2 Keeping Things Running
We aim for maximum uptime, but we can't guarantee 100% availability – sometimes things beyond our control happen, like provider issues or the internet having a bad day.
7.3 Backups
Regular backups are included with our hosting services, but it's always good practice to keep your own backups of important stuff too.
8. What We Promise
8.1 Our Service Guarantee
We promise to do our work with reasonable care and skill, following industry best practices.
8.2 Website Functionality
We provide a 30-day warranty on website functionality from launch day. This covers any bugs or issues directly related to our development work.
8.3 What We Can't Promise
We can't make guarantees about:
- Search engine rankings or SEO results (Google has its own ideas)
- Website traffic or conversion rates
- Third-party services working perfectly all the time
- Results from marketing campaigns
9. Liability Limits
If something goes wrong with our services, our total liability won't exceed what you've paid us for that specific project.
We won't be liable for any indirect losses, including loss of profits, data, or business opportunities – but we'll always do our best to make things right.
10. If We Need to Part Ways
10.1 If You Want to Stop
You can end a project anytime with written notice. You'll need to pay for work we've completed up to that point.
10.2 If We Need to Stop
We might need to end services if:
- Payments aren't being made
- These Terms aren't being followed
- The project changes significantly from what we originally agreed
- We're asked to do work that's illegal or unethical
11. Privacy and Data Protection
We take your privacy seriously and protect your personal information. Our Privacy Policy explains how we handle your data and forms part of these Terms.
We use appropriate security measures to keep your data and project information safe from unauthorised access.
12. When Things Are Out of Our Control
Sometimes events beyond anyone's control happen – natural disasters, pandemics, major technical failures, or other extraordinary circumstances. We won't be held responsible for delays caused by these situations.
13. The Legal Stuff
These Terms are governed by New Zealand law. Any disputes will be handled through the New Zealand court system. We're based in Taranaki, so this makes sense for everyone involved.
14. Updating These Terms
We might need to update these Terms occasionally. When we do, we'll post the updated version on our website with a new date. If you keep using our services, you're agreeing to the updated Terms.
For ongoing projects, we'll let you know directly about any significant changes.
